  1. General

    By accessing this website, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and you agree that you are responsible for compliance with any applicable laws in your locality. The materials contained in this web site are protected by applicable copyright, trademark, or intellectual property law. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

  2. Definitions

    "Us", "we", or "our" shall mean Blurred Media LLC.

    "Site" shall mean the website for which the Member is purchasing a username and password in order to access the website and its materials to obtain the benefits of membership.

    "Member" or "Customer" shall mean the person who is the user of the services of the Site and purchaser or legitimate holder of a working username and password pair for the Site.

    "User" shall mean any person who views the Site. This includes prospective Members, former Members, and individuals who have never been Members.

    "Membership", "Account", or "Access" shall mean the combination of unique username and password pair that is used by the Member to view the Site.

    "Biller" shall mean the 3rd party entity that processes payment from the Member on our behalf.

  3. Sanction and Approval of Adult Material

    The Site contains age-resricted materials. By accessing the Site, you certify that you are 18 years of age or older (or 21 years in some jurisdictions). You understand that you are viewing adult content, and you wish to do so.

  4. Member Device and Internet Connection

    The Member understands that in order to enjoy the benefits of Membership, the Memeber must use a device and configuration that is compatible with the Site and its standards. This generally includes, but is not limited to

    1. an internet connection of sufficient speed, or download rate;

    2. a mainstream, modern web browser like Google Chrome, Mozilla Firefox, Microsoft EDGE, or Apple Safari;

    3. a configuration that allows our use of Cookies and JavaScript;

    4. a configuration that allows all necessary domains and IP addresses used by the Site;

    5. support for the content encoding used by the Site;

    6. a configuration that does not add, modify, alter, or erase, in part or in whole, HTTP headers or similar information; and

    7. a configuration that does not use a Proxy, VPN, Tor, AdBlock, "incognito mode", anti-virus, or similar service that may modify network requests to the Site.

    We take measures and use standards to ensure wide compadibility for viewing and enjoying Membership. However, we do not make effort to support lesser-know browsers, namely Puffin, UC Browser, B-Line, and "mini-browsers", among others. The User is advised to use the "tour" or promotional area of the Site to test their device and configuration before purchasing the Membership.

  5. Use License

    The use license granted to the Member may differ depending on the tier and terms of their individual Membership.

    1. For "streaming-only" Memberships, the Member is permitted to temporarily download, but not retain, one copy of the materials on the Site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

      1. modify or copy the materials;

      2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

      3. attempt to decompile or reverse engineer any software contained on the Site;

      4. attempt to defeat or circumvent measures we have taken to prohibit the download of a copy of materials;

      5. attempt to reteive from device memory, a copy of materials;

      6. remove any copyright or other proprietary notations from the materials; or

      7. transfer the materials to another person or "mirror" the materials on any other server.

    2. For "download-enabled" Memberships, the Member is permitted to download copies of the materials on the Site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

      1. modify the materials;

      2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

      3. attempt to decompile or reverse engineer any software contained on the Site;

      4. remove any copyright or other proprietary notations from the materials; or

      5. transfer the materials to another person or "mirror" the materials on any other server.

    3. This license shall automatically terminate if you breach any of these restrictions and may be terminated by us at any time. Upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

  6. Billing and Payment

    We use a number of 3rd Party, reputable payment processors ("Billers") to accept payment for Membership from Members. These Billers include Epoch, CCBill, GoCoin, among others. We do not process or handle any of the Member's financial information. The Site has links to the Billers on the bottom of the Site's pages or on the Site's initial Membership join form.

    The Member understands that, since we do not process transactions ourselves, or handle the related data needed to process a transaction, that means...

    1. the Member should never send us their financial information for any reason;

    2. we will not process a transaction or cancel a transaction for the Member; and

    3. the Member must contact the Biller for issues relating directly to billing, payments, or financial information needed to process payment.

    We offer Memberships that automatically renew, and the Biller may automatically attemp to charge your method of payment each period. The rates and terms of Membership are displayed on the Biller's protected payment form, as well as in an electronic receipt sent to the Member. If the Member wishes to stop future charges, the Member must cancel the Membership with the Biller.

    The Biller may decline a transaction at their own discression. If you are declined for a transaction, you will need to contact the Biller, your credit card issuer, or bank to obtain the reason for decline. We cannot obtain this information for you. We cannot overrule the Biller on a declined transaction. The Member may contact the Biller to update or manage their payment details or use a different credit card as needed.

    In the event of a declined transaction on an automatically-rebilling Membership, the Biller may make a second or multiple attempts to process payment as late as days after the declined transaction. During that time, the Biller's website or Account portal may indicate that your Membership with us is "current". However, we will immedately disable access until a successful payment is processed by the Biller. When this is the case, we may show an "account expired" message at login.

    Unless specified elsewhere, prices on the Site are measured in United States Dollars (USD).

  10. Cancellation

    At any time, for any reason, or no reason at all, We or the Member can cancel or terminate the Membership. Depending on the timing and circumstances, the Membership may terminate days after the cancellation, but not longer than one billing cycle after cancellation. We do not need to notify the Member if we have canceled or terminated the Membership.

    Further, the Member understands that should impairment of their ability to access the Site arise, that impairment alone does not constitute cancellation. The Member must still directly contact the Biller or utilize the Biller's website to cancel Membership and stop future charges.

    In order for the Member to sufficiently cancel Membership and stop future charges, the Member understands that...

    1. the Member must contact the Biller directly, or use the Biller's web site to process the cancellation;

    2. contact details for the Biller are generally available on their electronic receipt, and linked on the Site;

    3. contacting us directly in lieu of the Biller is not sufficient to process a cancellation;

    4. contacting us directly in lieu of the Biller does not establish an effective date of cancellation; and

    5. we are not obligated to process a cancellation behalf of the Member.

  11. Refunds

    The Member may request refunds for purchases or recurring charges via contacting us directly or contacting the Biller promplty when an issue arises. We may instruct the Biller to grant refunds for accidental purchases, or for technical difficulties where the Membership has not been used. We will not grant refunds for partially-used Memberships. Generally, we will not grant refunds on issues more than 30 days in the past. We will not grant refunds in cases of abuse of the Site or its services.

    We reserve the right to grant or deny refunds at our discretion. The decision to refund a charge does not imply the obligation to issue additional future refunds. We may grant additional days of Membership at no cost in lieu of instructing the Biller to refund.

  12. Cardholder Disputes

    In the event of an excessive refund or chargeback, we will investigate the details fully and take measures to prevent future transactions, abuse, and Site access. We instruct the Biller to blacklist the details used so that no further transactions may occur. We will permanently ban all IP addresses associated with chargebacks.

    If fraud or theft is suspected, the card issuer will be warned to protect the cardholder, issuer, and other merchants against future fraudlent charges. We will also contact the Internet Service Provider(s) of the IP address(es) connected to the chargeback Account, and demand the immedate termination of services. This includes any IP address we have recorded on the Membership, as well as any related IP addresses we can link using common metadata. When appropriate, we may demand records subscriber information from the ISP for use in a civil claim. Depending on jurisdiction, we may contact and report incidents of fraud with the appropriate law-enforcement agency.

  13. Privacy Policy

    For details relating to our data collection and use, please refer to our separate privacy policy document, linked on the Site.

  14. Communication

    When the Member wishes to or needs to contact us, the Member will communicate via email. We do not offer any other methods of direct communication for Members. For action or service to be taken on the Member's Account, the Member must use the exact email address used to create Membership on record with the Biller. We will not answer requests or questions on the Membership if the email address used for purchase is not used.

  15. Disclaimer

    The materials on the Site are provided "as is". We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other breach of rights. Further, we do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Site or otherwise relating to such materials or on any sites linked to this site.

  16. Limitations

    In no event shall we or our suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on the Site, even if we or our authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

  17. Severability

    If any provision of this agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid or enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

  18. Revisions and Errata

    The materials appearing on the Site could include technical, typographical, or photographic errors. We do not warrant that any of the materials on the Site are accurate, complete, or current. We may make changes to the materials contained on the Site at any time without notice. We do not, however, make any commitment to update the materials.

  19. Links

    We have not reviewed all of the external sites linked to the Site, and we are not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by us of the external site. Use of any such linked web site is at the User's own risk.

  20. Site Terms of Service Modifications

    We may revise these terms of service for the Site at any time without notice. By using the Site, you are agreeing to be bound by the then current version of these Terms and Conditions of Service.

  21. Governing Law
